O projeto foi encaminhado ao Legislativo pelo governo Temer e prop\u00f5e uma reformula\u00e7\u00e3o nas regras trabalhistas.<\/p>\n<\/div>\n<div class=\"mc-column content-text active-extra-styles \" data-block-type=\"unstyled\" data-block-weight=\"62\">\n<p class=\"content-text__container \" data-track-category=\"Link no Texto\" data-track-links=\"\">O parecer apresentado pelo relator Rog\u00e9rio Marinho (PSDB-RN) teve 24 destaques &#8211; pedidos de altera\u00e7\u00e3o no texto &#8211; apresentados pelos membros do colegiado, mas que n\u00e3o foram analisados por causa do in\u00edcio da ordem do dia na C\u00e2mara. Os pedidos perderam o efeito e precisar\u00e3o ser novamente apresentados no plen\u00e1rio, onde ser\u00e3o analisados ap\u00f3s a vota\u00e7\u00e3o do texto-base, se ele for aprovado.<\/p>\n<\/div>\n<div class=\"mc-column content-text active-extra-styles \" data-block-type=\"unstyled\" data-block-weight=\"46\">\n<p class=\"content-text__container \" data-track-category=\"Link no Texto\" data-track-links=\"\">Para ser aprovada no plen\u00e1rio da C\u00e2mara, a reforma trabalhista precisa dos votos favor\u00e1veis da maioria simples dos deputados, ou seja, respeitado o qu\u00f3rum m\u00ednimo de 257 parlamentares na sess\u00e3o, o projeto \u00e9 aprovado se o n\u00famero de votos \u201csim\u201d corresponder \u00e0 maioria dos votos v\u00e1lidos.<\/p>\n<\/div>\n<div class=\"mc-column content-text active-extra-styles \" data-block-type=\"unstyled\" data-block-weight=\"37\">\n<p class=\"content-text__container \" data-track-category=\"Link no Texto\" data-track-links=\"\">Segundo <a href=\"http:\/\/g1.globo.com\/politica\/blog\/blog-do-camarotti\/post\/ministros-se-afastarao-para-votar-reforma-trabalhista-na-camara.html\">adiantou o blog do Camarotti<\/a>, os ministros Mendon\u00e7a Filho (DEM), da Educa\u00e7\u00e3o, Fernando Bezerra Filho (PSB), de Minas e Energia, e Bruno Ara\u00fajo (PSDB), das Cidades, ir\u00e3o se afastar para votar com o governo no plen\u00e1rio.<\/p>\n<\/div>\n<div class=\"mc-column content-text active-extra-styles \" data-block-type=\"unstyled\" data-block-weight=\"28\">\n<p class=\"content-text__container \" data-track-category=\"Link no Texto\" data-track-links=\"\">A expectativa do presidente da C\u00e2mara, Rodrigo Maia (DEM-RJ), \u00e9 concluir o processo de vota\u00e7\u00e3o na C\u00e2mara at\u00e9 quinta-feira. Depois disso, a proposta segue para aprecia\u00e7\u00e3o do Senado.<\/p>\n<\/div>\n<p><!--more--><\/p>\n<div class=\"mc-column content-text active-extra-styles \" data-block-type=\"unstyled\" data-block-weight=\"4\">\n<p class=\"content-text__container \" data-track-category=\"Link no Texto\" data-track-links=\"\"><strong>Principais pontos do parecer:<\/strong><\/p>\n<\/div>\n<div class=\"mc-column content-text active-extra-styles\" data-block-type=\"raw\" data-block-weight=\"113\">\n<ul class=\"content-unordered-list\">\n<li>As f\u00e9rias poder\u00e3o ser parceladas em tr\u00eas vezes ao longo do ano;<\/li>\n<li>A contribui\u00e7\u00e3o sindical, hoje obrigat\u00f3ria, passa a ser opcional;<\/li>\n<li>Patr\u00f5es e empregados podem negociar, por exemplo jornada de trabalho e cria\u00e7\u00e3o de banco de horas;<\/li>\n<li>Haver\u00e1 multa de R$ 3 mil por cada trabalhador n\u00e3o registrado. No caso de micro e pequenas empresas, o valor cai para R$ 800.<\/li>\n<li>O trabalho em casa (home office) entra na legisla\u00e7\u00e3o e ter\u00e1 regras espec\u00edficas, como reembolso por despesas do empregado;<\/li>\n<li>Ju\u00edzes poder\u00e3o dar multa a quem agir com m\u00e1-f\u00e9 em processos trabalhistas;<\/li>\n<li>Gestante pode trabalhar em ambiente insalubre desde que trabalhadores, passando a ter for\u00e7a de lei. O relator, por\u00e9m, incluiu diversas mudan\u00e7as. (<em>veja os detalhes do relat\u00f3rio ao fim desta reportagem<\/em>)<\/p>\n<\/div>\n<div class=\"mc-column content-text active-extra-styles \" data-block-type=\"unstyled\" data-block-weight=\"33\">\n<p class=\"content-text__container \" data-track-category=\"Link no Texto\" data-track-links=\"\">Inicialmente, o projeto da reforma trabalhista tinha car\u00e1ter conclusivo, ou seja, iria direto \u00e0 aprecia\u00e7\u00e3o do Senado ap\u00f3s aprova\u00e7\u00e3o na comiss\u00e3o especial da C\u00e2mara, sem necessidade de passar pelo plen\u00e1rio principal da Casa.<\/p>\n<\/div>\n<div class=\"mc-column content-text active-extra-styles \" data-block-type=\"unstyled\" data-block-weight=\"27\">\n<p class=\"content-text__container \" data-track-category=\"Link no Texto\" data-track-links=\"\">Na \u00faltima semana, por\u00e9m, os deputados aprovaram um requerimento de tramita\u00e7\u00e3o em regime de urg\u00eancia. Com a decis\u00e3o, o texto aprovado pela comiss\u00e3o seguir\u00e1 para o plen\u00e1rio.<\/p>\n<\/div>\n<div class=\"mc-column content-text active-extra-styles \" data-block-type=\"unstyled\" data-block-weight=\"1\">\n<p class=\"content-text__container \" data-track-category=\"Link no Texto\" data-track-links=\"\"><strong>Vota\u00e7\u00e3o<\/strong><\/p>\n<\/div>\n<div class=\"mc-column content-text active-extra-styles \" data-block-type=\"unstyled\" data-block-weight=\"31\">\n<p class=\"content-text__container \" data-track-category=\"Link no Texto\" data-track-links=\"\">No debate da comiss\u00e3o, membros da base aliada argumentaram que o texto moderniza a lei trabalhista. A oposi\u00e7\u00e3o, por outro lado, criticou a proposta, afirmando que ela retira direitos dos trabalhadores.<\/p>\n<\/div>\n<div class=\"mc-column content-text active-extra-styles \" data-block-type=\"unstyled\" data-block-weight=\"32\">\n<p class=\"content-text__container \" data-track-category=\"Link no Texto\" data-track-links=\"\">A bancada do PSB se mostrou dividida. Na segunda (24), a Executiva Nacional do partido, que comanda o minist\u00e9rio de Minas e Energia, <a href=\"http:\/\/g1.globo.com\/politica\/noticia\/integrante-da-base-de-temer-psb-decide-votar-contra-reforma-trabalhista.ghtml\">decidiu fechar quest\u00e3o contra as reformas do governo Temer<\/a>.<\/p>\n<\/div>\n<div class=\"mc-column content-text active-extra-styles \" data-block-type=\"unstyled\" data-block-weight=\"25\">\n<p class=\"content-text__container \" data-track-category=\"Link no Texto\" data-track-links=\"\">O deputado Fabio Garcia (PSB-MT) contrariou a orienta\u00e7\u00e3o e votou a favor do parecer. n\u00e3o poder\u00e3o ser menores do que 5 dias corridos, cada um. Por outro lado, as empresas n\u00e3o poder\u00e3o discutir, por exemplo, o fundo de garanta, o sal\u00e1rio m\u00ednimo, o d\u00e9cimo terceiro e as f\u00e9rias proporcionais.<\/p>\n<\/div>\n<div class=\"mc-column content-text active-extra-styles\" data-block-type=\"raw\" data-block-weight=\"1\">\n<div class=\"content-intertitle\">\n<h2><strong>Terceiriza\u00e7\u00e3o<\/strong><\/h2>\n<\/div>\n<\/div>\n<div class=\"mc-column content-text active-extra-styles \" data-block-type=\"unstyled\" data-block-weight=\"31\">\n<p class=\"content-text__container \" data-track-category=\"Link no Texto\" data-track-links=\"\">O relat\u00f3rio prop\u00f5e uma s\u00e9rie de salvaguardas para o trabalhador terceirizado. Em mar\u00e7o, o presidente Michel Temer sancionou uma lei que permite a terceiriza\u00e7\u00e3o para todas as atividades de uma empresa.<\/p>\n<\/div>\n<div class=\"mc-column content-text active-extra-styles \" data-block-type=\"unstyled\" data-block-weight=\"26\">\n<p class=\"content-text__container \" data-track-category=\"Link no Texto\" data-track-links=\"\">O parecer inclui uma esp\u00e9cie de quarentena, na qual o empregador n\u00e3o poder\u00e1 demitir o trabalhador efetivo e recontrat\u00e1-lo como terceirizado num per\u00edodo de 18 meses.<\/p>\n<\/div>\n<div class=\"mc-column content-text active-extra-styles \" data-block-type=\"unstyled\" data-block-weight=\"27\">\n<p class=\"content-text__container \" data-track-category=\"Link no Texto\" data-track-links=\"\">A empresa que recepcionar um empregado terceirizado ter\u00e1, ainda, que manter todas as condi\u00e7\u00f5es que esse trabalhador tem na empregadora-m\u00e3e, como uso de ambulat\u00f3rio, alimenta\u00e7\u00e3o e seguran\u00e7a.<\/p>\n<\/div>\n<div class=\"mc-column content-text active-extra-styles\" data-block-type=\"raw\" data-block-weight=\"2\">\n<div class=\"content-intertitle\">\n<h2><strong>Contribui\u00e7\u00e3o sindical<\/strong><\/h2>\n<\/div>\n<\/div>\n<div class=\"mc-column content-text active-extra-styles \" data-block-type=\"unstyled\" data-block-weight=\"41\">\n<p class=\"content-text__container \" data-track-category=\"Link no Texto\" data-track-links=\"\">Atualmente, o pagamento da contribui\u00e7\u00e3o sindical \u00e9 obrigat\u00f3rio e vale para empregados sindicalizados ou n\u00e3o. Uma vez ao ano, \u00e9 descontado o equivalente a um dia de sal\u00e1rio do trabalhador. Se a mudan\u00e7a for aprovada, a contribui\u00e7\u00e3o passar\u00e1 a ser opcional.<\/p>\n<\/div>\n<div class=\"mc-column content-text active-extra-styles\" data-block-type=\"raw\" data-block-weight=\"1\">\n<div class=\"content-intertitle\">\n<h2><strong>Multa<\/strong><\/h2>\n<\/div>\n<\/div>\n<div class=\"mc-column content-text active-extra-styles \" data-block-type=\"unstyled\" data-block-weight=\"29\">\n<p class=\"content-text__container \" data-track-category=\"Link no Texto\" data-track-links=\"\">Pela legisla\u00e7\u00e3o atual, o empregador que mant\u00e9m empregado n\u00e3o registrado fica sujeito a multa de um sal\u00e1rio-m\u00ednimo regional, por empregado n\u00e3o registrado, acrescido de igual valor em cada reincid\u00eancia.<\/p>\n<\/div>\n<div class=\"mc-column content-text active-extra-styles \" data-block-type=\"unstyled\" data-block-weight=\"60\">\n<p class=\"content-text__container \" data-track-category=\"Link no Texto\" data-track-links=\"\">Na reforma enviada pelo governo, o texto prop\u00f5e multa de R$ 6 mil por empregado n\u00e3o registrado, acrescido de igual valor em cada reincid\u00eancia. No caso de microempresa ou empresa de pequeno porte, a multa prevista \u00e9 de R$ 1 mil. O texto prev\u00ea ainda que o empregador dever\u00e1 manter registro dos respectivos trabalhadores sob pena de R$ 1 mil.<\/p>\n<\/div>\n<div class=\"mc-column content-text active-extra-styles \" data-block-type=\"unstyled\" data-block-weight=\"48\">\n<p class=\"content-text__container \" data-track-category=\"Link no Texto\" data-track-links=\"\">Em seu parecer, por\u00e9m, Rog\u00e9rio Marinho reduziu o valor da multa para R$ 3 mil para cada empregado n\u00e3o registrado. No caso de micro e pequenas empresas, a multa ser\u00e1 de R$ 800. Na hip\u00f3tese de n\u00e3o serem informados os registros, ele reduziu a multa para R$ 600.<\/p>\n<\/div>\n<div class=\"mc-column content-text active-extra-styles\" data-block-type=\"raw\" data-block-weight=\"3\">\n<div class=\"content-intertitle\">\n<h2><strong>Jornada de trabalho<\/strong><\/h2>\n<\/div>\n<\/div>\n<div class=\"mc-column content-text active-extra-styles \" data-block-type=\"unstyled\" data-block-weight=\"55\">\n<p class=\"content-text__container \" data-track-category=\"Link no Texto\" data-track-links=\"\">Hoje, a legisla\u00e7\u00e3o n\u00e3o conta como jornada de trabalho o tempo gasto pelo trabalhador no deslocamento at\u00e9 o local de trabalho e na volta para casa, por qualquer meio de transporte. A exce\u00e7\u00e3o \u00e9 quando o empregado usa transporte fornecido pelo empregador por ser um local de dif\u00edcil acesso ou onde n\u00e3o h\u00e1 transporte p\u00fablico.<\/p>\n<\/div>\n<div class=\"mc-column content-text active-extra-styles \" data-block-type=\"unstyled\" data-block-weight=\"69\">\n<p class=\"content-text__container \" data-track-category=\"Link no Texto\" data-track-links=\"\">O relator modifica o texto para deixar claro que n\u00e3o ser\u00e1 computado na jornada de trabalho o tempo que o empregado levar at\u00e9 \u201ca efetiva ocupa\u00e7\u00e3o do posto de trabalho\u201d e n\u00e3o mais at\u00e9 o local de trabalho. Al\u00e9m disso, deixa de considerar como jornada de trabalho o tempo usado pelo empregado no trajeto utilizando meio de transporte fornecido pelo empregador \u201cpor n\u00e3o ser tempo \u00e0 disposi\u00e7\u00e3o do empregador\u201d.<\/p>\n<\/div>\n<div class=\"mc-column content-text active-extra-styles \" data-block-type=\"unstyled\" data-block-weight=\"61\">\n<p class=\"content-text__container \" data-track-category=\"Link no Texto\" data-track-links=\"\">Tamb\u00e9m n\u00e3o ser\u00e1 computado como extra o per\u00edodo que exceder a jornada normal quando o empregado, por escolha pr\u00f3pria, buscar prote\u00e7\u00e3o pessoal, em caso de inseguran\u00e7a nas vias p\u00fablicas ou m\u00e1s condi\u00e7\u00f5es clim\u00e1ticas, ou ficar nas depend\u00eancias da empresa para exercer atividades particulares, como higiene e troca de roupa ou uniforme, quando n\u00e3o houver obrigatoriedade de realizar a troca na empresa.<\/p>\n<\/div>\n<div class=\"mc-column content-text active-extra-styles\" data-block-type=\"raw\" data-block-weight=\"2\">\n<div class=\"content-intertitle\">\n<h2><strong>Regime parcial<\/strong><\/h2>\n<\/div>\n<\/div>\n<div class=\"mc-column content-text active-extra-styles \" data-block-type=\"unstyled\" data-block-weight=\"33\">\n<p class=\"content-text__container \" data-track-category=\"Link no Texto\" data-track-links=\"\">A lei em vigor considera trabalho em regime de tempo parcial aquele cuja dura\u00e7\u00e3o n\u00e3o passe de 25 horas semanais. Pela legisla\u00e7\u00e3o atual, \u00e9 proibida a realiza\u00e7\u00e3o de hora extra no regime parcial.<\/p>\n<\/div>\n<div class=\"mc-column content-text active-extra-styles \" data-block-type=\"unstyled\" data-block-weight=\"60\">\n<p class=\"content-text__container \" data-track-category=\"Link no Texto\" data-track-links=\"\">O parecer do relator aumenta essa carga para 30 horas semanais, sem a possibilidade de horas suplementares por semana. Tamb\u00e9m passa a considerar trabalho em regime de tempo parcial aquele que n\u00e3o passa de 26 horas por semana, com a possibilidade de 6 horas extras semanais. As horas extras ser\u00e3o pagas com o acr\u00e9scimo de 50% sobre o sal\u00e1rio-hora normal.<\/p>\n<\/div>\n<div class=\"mc-column content-text active-extra-styles \" data-block-type=\"unstyled\" data-block-weight=\"18\">\n<p class=\"content-text__container \" data-track-category=\"Link no Texto\" data-track-links=\"\">As horas extras poder\u00e3o ser compensadas diretamente at\u00e9 a semana seguinte. Caso isso n\u00e3o aconte\u00e7a, dever\u00e3o ser pagas.<\/p>\n<\/div>\n<div class=\"mc-column content-text active-extra-styles\" data-block-type=\"raw\" data-block-weight=\"2\">\n<div class=\"content-intertitle\">\n<h2><strong>Regime normal<\/strong><\/h2>\n<\/div>\n<\/div>\n<div class=\"mc-column content-text active-extra-styles \" data-block-type=\"unstyled\" data-block-weight=\"60\">\n<p class=\"content-text__container \" data-track-category=\"Link no Texto\" data-track-links=\"\">Em rela\u00e7\u00e3o ao regime normal de trabalho, o parecer mant\u00e9m a previs\u00e3o de, no m\u00e1ximo, duas horas extras di\u00e1rias, mas estabelece que as regras poder\u00e3o ser fixadas por \u201cacordo individual, conven\u00e7\u00e3o coletiva ou acordo coletivo de trabalho\u201d. Hoje, a CLT diz que isso s\u00f3 poder\u00e1 ser estabelecido \u201cmediante acordo escrito entre empregador e empregado, ou mediante contrato coletivo de trabalho\u201d.<\/p>\n<\/div>\n<div class=\"mc-column content-text active-extra-styles \" data-block-type=\"unstyled\" data-block-weight=\"25\">\n<p class=\"content-text__container \" data-track-category=\"Link no Texto\" data-track-links=\"\">Pela regra atual, a remunera\u00e7\u00e3o da hora extra dever\u00e1 ser, pelo menos, 20% superior \u00e0 da hora normal. O relator aumenta esse percentual para 50%.<\/p>\n<\/div>\n<div class=\"mc-column content-text active-extra-styles\" data-block-type=\"raw\" data-block-weight=\"3\">\n<div class=\"content-intertitle\">\n<h2><strong>Banco de horas<\/strong><\/h2>\n<\/div>\n<\/div>\n<div class=\"mc-column content-text active-extra-styles \" data-block-type=\"unstyled\" data-block-weight=\"53\">\n<p class=\"content-text__container \" data-track-category=\"Link no Texto\" data-track-links=\"\">Hoje, a lei prev\u00ea a compensa\u00e7\u00e3o da hora extra em outro dia de trabalho, desde que n\u00e3o exceda, no per\u00edodo m\u00e1ximo de um ano, \u00e0 soma das jornadas semanais de trabalho previstas, nem seja ultrapassado o limite m\u00e1ximo de dez horas di\u00e1rias. A regra \u00e9 estabelecida por acordo ou conven\u00e7\u00e3o coletiva de trabalho.<\/p>\n<\/div>\n<div class=\"mc-column content-text active-extra-styles \" data-block-type=\"unstyled\" data-block-weight=\"60\">\n<p class=\"content-text__container \" data-track-category=\"Link no Texto\" data-track-links=\"\">O texto do relator prev\u00ea que o banco de horas poder\u00e1 ser pactuado por acordo individual escrito, desde que a compensa\u00e7\u00e3o ocorra no per\u00edodo m\u00e1ximo de seis meses. Al\u00e9m disso, poder\u00e1 ser ajustada, por acordo individual ou coletivo, qualquer forma de compensa\u00e7\u00e3o de jornada, desde que n\u00e3o passe de dez horas di\u00e1rias e que a compensa\u00e7\u00e3o aconte\u00e7a no mesmo m\u00eas.<\/p>\n<\/div>\n<div class=\"mc-column content-text active-extra-styles\" data-block-type=\"raw\" data-block-weight=\"6\">\n<div class=\"content-intertitle\">\n<h2><strong>Jornada de 12 x 36 horas<\/strong><\/h2>\n<\/div>\n<\/div>\n<div class=\"mc-column content-text active-extra-styles \" data-block-type=\"unstyled\" data-block-weight=\"44\">\n<p class=\"content-text__container \" data-track-category=\"Link no Texto\" data-track-links=\"\">Hoje, a Justi\u00e7a autoriza a realiza\u00e7\u00e3o da jornada de 12 horas de trabalho alternados por 36 horas de descanso para algumas categorias. Esse tipo de jornada de trabalho \u00e9 seguido por v\u00e1rias categorias, sendo observado o limite semanal de cada profiss\u00e3o em legisla\u00e7\u00e3o espec\u00edfica.<\/p>\n<\/div>\n<div class=\"mc-column content-text active-extra-styles \" data-block-type=\"unstyled\" data-block-weight=\"29\">\n<p class=\"content-text__container \" data-track-category=\"Link no Texto\" data-track-links=\"\">Com a reforma trabalhista, a jornada 12&#215;36 passa a fazer parte da legisla\u00e7\u00e3o. O texto tamb\u00e9m prev\u00ea que a remunera\u00e7\u00e3o mensal incluir\u00e1 descanso semanal remunerado e descanso em feriados.<\/p>\n<\/div>\n<div class=\"mc-column content-text active-extra-styles\" data-block-type=\"raw\" data-block-weight=\"5\">\n<div class=\"content-intertitle\">\n<h2><strong>Trabalho remoto ou home office<\/strong><\/h2>\n<\/div>\n<\/div>\n<div class=\"mc-column content-text active-extra-styles \" data-block-type=\"unstyled\" data-block-weight=\"18\">\n<p class=\"content-text__container \" data-track-category=\"Link no Texto\" data-track-links=\"\">Atualmente, n\u00e3o h\u00e1 previs\u00e3o na legisla\u00e7\u00e3o para o trabalho home office, como quando o empregado trabalha de casa.<\/p>\n<\/div>\n<div class=\"mc-column content-text active-extra-styles \" data-block-type=\"unstyled\" data-block-weight=\"50\">\n<p class=\"content-text__container \" data-track-category=\"Link no Texto\" data-track-links=\"\">O texto do relator inclui o trabalho em casa na legisla\u00e7\u00e3o e estabelece regras para a sua presta\u00e7\u00e3o. Ele define, por exemplo, que o comparecimento \u00e0s depend\u00eancias do empregador para a realiza\u00e7\u00e3o de atividades espec\u00edficas que exijam a presen\u00e7a do empregado no estabelecimento n\u00e3o descaracteriza o regime de trabalho remoto.<\/p>\n<\/div>\n<div class=\"mc-column content-text active-extra-styles \" data-block-type=\"unstyled\" data-block-weight=\"51\">\n<p class=\"content-text__container \" data-track-category=\"Link no Texto\" data-track-links=\"\">Dever\u00e1 haver um contrato individual de trabalho especificando as atividades que ser\u00e3o realizadas pelo empregado. O contrato tamb\u00e9m dever\u00e1 fixar a responsabilidade sobre aquisi\u00e7\u00e3o, manuten\u00e7\u00e3o ou fornecimento dos equipamentos, al\u00e9m da infraestrutura necess\u00e1ria, assim como ao reembolso de despesas arcadas pelo empregado. As utilidades n\u00e3o poder\u00e3o integrar a remunera\u00e7\u00e3o do empregado.<\/p>\n<\/div>\n<div class=\"mc-column content-text active-extra-styles\" data-block-type=\"raw\" data-block-weight=\"4\">\n<div class=\"content-intertitle\">\n<h2><strong>Mulheres e trabalho insalubre<\/strong><\/h2>\n<\/div>\n<\/div>\n<div class=\"mc-column content-text active-extra-styles \" data-block-type=\"unstyled\" data-block-weight=\"33\">\n<p class=\"content-text__container \" data-track-category=\"Link no Texto\" data-track-links=\"\">Atualmente, a lei pro\u00edbe que mulheres gr\u00e1vidas ou lactantes trabalhem em ambientes com condi\u00e7\u00f5es insalubres. Ele fixa crit\u00e9rios objetivos que dever\u00e3o ser seguidos pelos ju\u00edzes para definir o valor da indeniza\u00e7\u00e3o.<\/p>\n<\/div>\n<div class=\"mc-column content-text active-extra-styles\" data-block-type=\"raw\" data-block-weight=\"2\">\n<div class=\"content-intertitle\">\n<h2><strong>Trabalhador aut\u00f4nomo<\/strong><\/h2>\n<\/div>\n<\/div>\n<div class=\"mc-column content-text active-extra-styles \" data-block-type=\"unstyled\" data-block-weight=\"25\">\n<p class=\"content-text__container \" data-track-category=\"Link no Texto\" data-track-links=\"\">O texto do relator deixa claro que a contrata\u00e7\u00e3o do aut\u00f4nomo, com ou sem exclusividade, de forma cont\u00ednua ou n\u00e3o, afasta a qualidade de empregado.<\/p>\n<\/div>\n<div class=\"mc-column content-text active-extra-styles\" data-block-type=\"raw\" data-block-weight=\"2\">\n<div class=\"content-intertitle\">\n<h2><strong>Trabalho intermitente<\/strong><\/h2>\n<\/div>\n<\/div>\n<div class=\"mc-column content-text active-extra-styles \" data-block-type=\"unstyled\" data-block-weight=\"47\">\n<p class=\"content-text__container \" data-track-category=\"Link no Texto\" data-track-links=\"\">Sobre o contrato individual de trabalho, o relator mant\u00e9m que ele poder\u00e1 ser acordado verbalmente ou por escrito, por prazo determinado ou indeterminado, mas inclui a previs\u00e3o para que o trabalho seja prestado de forma intermitente, que permite a contrata\u00e7\u00e3o de funcion\u00e1rios sem hor\u00e1rio fixo de trabalho.<\/p>\n<\/div>\n<div class=\"mc-column content-text active-extra-styles \" data-block-type=\"unstyled\" data-block-weight=\"42\">\n<p class=\"content-text__container \" data-track-category=\"Link no Texto\" data-track-links=\"\">O contrato dever\u00e1 ser por escrito e conter especificamente o valor da hora de trabalho, que n\u00e3o pode ser inferior ao valor hor\u00e1rio do sal\u00e1rio m\u00ednimo ou \u00e0quele pago aos demais empregados que exer\u00e7am a mesma fun\u00e7\u00e3o em contrato intermitente ou n\u00e3o.<\/p>\n<\/div>\n<div class=\"mc-column content-text active-extra-styles \" data-block-type=\"unstyled\" data-block-weight=\"59\">\n<p class=\"content-text__container \" data-track-category=\"Link no Texto\" data-track-links=\"\">O empregado dever\u00e1 ser convocado com, no m\u00ednimo, tr\u00eas dias corridos de anteced\u00eancia. No per\u00edodo de inatividade, o trabalhador prestar servi\u00e7os a outros contratantes. Ao final de cada per\u00edodo de presta\u00e7\u00e3o de servi\u00e7o, o empregado receber\u00e1 o pagamento imediato das parcelas do sal\u00e1rio, f\u00e9rias e d\u00e9cimo terceiro sal\u00e1rio proporcionais. class=\"mc-column content-text active-extra-styles\" data-block-type=\"raw\" data-block-weight=\"15\">\n<div class=\"content-intertitle\">\n<h2><strong>Pontos que podem ser negociados ou n\u00e3o em acordos coletivos para ter for\u00e7a de lei<\/strong><\/h2>\n<\/div>\n<\/div>\n<div class=\"mc-column content-text active-extra-styles \" data-block-type=\"unstyled\" data-block-weight=\"11\">\n<p da indeniza\u00e7\u00e3o rescis\u00f3ria do FGTS;<\/li>\n<li>sal\u00e1rio-m\u00ednimo;<\/li>\n<li>valor nominal do d\u00e9cimo terceiro sal\u00e1rio;<\/li>\n<li>remunera\u00e7\u00e3o do trabalho noturno superior \u00e0 do diurno;<\/li>\n<li>prote\u00e7\u00e3o do sal\u00e1rio na forma da lei;<\/li>\n<li>sal\u00e1rio-fam\u00edlia;<\/li>\n<li>repouso semanal remunerado;<\/li>\n<li>remunera\u00e7\u00e3o do servi\u00e7o extraordin\u00e1rio superior, no m\u00ednimo, em 50% \u00e0 do normal;<\/li>\n<li>n\u00famero de dias de f\u00e9rias devidas ao empregado;<\/li>\n<li>gozo de f\u00e9rias anuais remuneradas com, pelo menos, um ter\u00e7o a mais do que o sal\u00e1rio normal;<\/li>\n<li>licen\u00e7a-maternidade com a dura\u00e7\u00e3o m\u00ednima de 120 dias;<\/li>\n<li>licen\u00e7a-paternidade nos termos fixados em lei;<\/li>\n<li>prote\u00e7\u00e3o do mercado de trabalho da mulher, mediante incentivos espec\u00edficos<\/li>\n<li>aviso pr\u00e9vio proporcional ao tempo de servi\u00e7o, sendo no m\u00ednimo de trinta dias;<\/li>\n<li>normas de sa\u00fade, higiene e seguran\u00e7a do trabalho;<\/li>\n<li>adicional de remunera\u00e7\u00e3o para as atividades penosas, insalubres ou perigosas;<\/li>\n<li>aposentadoria;<\/li>\n<li>seguro contra acidentes de trabalho, a cargo do empregador;<\/li>\n<li>a\u00e7\u00e3o, aprendiz, a partir de quatorze anos;<\/li>\n<li>medidas de prote\u00e7\u00e3o legal de crian\u00e7as e adolescentes;<\/li>\n<li>igualdade de direitos entre o trabalhador com v\u00ednculo empregat\u00edcio permanente e o trabalhador avulso;<\/li>\n<li>liberdade de associa\u00e7\u00e3o profissional ou sindical do trabalhador;<\/li>\n<li>direito de greve;<\/li>\n<li>defini\u00e7\u00e3o
